Terms & Conditions

These terms apply when you buy plants or book delivery or planting from Italy Gardens & Nursery. Please read them before you confirm an order.

Prices and quotes

Prices are given on request. Before you pay anything we confirm in writing the plants and sizes, the price, any delivery or planting cost, VAT where it applies, and the expected delivery date. A quote is valid for the period stated on it, as availability of living plants changes.

Orders

You can order by WhatsApp, email, phone or at the nursery. Saving plants to your basket or sending an enquiry through the website is a request, not an order. The contract starts when you accept our written confirmation. Plants sourced to order from our partner growers in Italy are confirmed once the grower has reserved them for you.

Payment

We accept card and bank transfer, and invoice trade accounts on the terms agreed with them. Any deposit is stated on your confirmation.

Delivery

We deliver across Northern Ireland and the Republic of Ireland, and to Great Britain on request. Delivery dates are agreed with you. Please make sure the plants can be unloaded safely and someone is there to accept them, unless we have agreed otherwise in writing. The plants are your responsibility once delivered.

Your right to cancel (consumers)

If you are a consumer and ordered without visiting the nursery (for example by WhatsApp, email or phone), you may cancel within 14 days of the day the plants are delivered, without giving a reason. Tell us clearly by email or in writing.

Please keep the plants watered and in the condition they arrived in. Unless the plants are faulty, you pay the direct cost of returning them, or we can collect them for a charge we confirm first. We refund the price and the standard delivery cost within 14 days of getting the plants back. We may reduce the refund if the plants have deteriorated because they were not looked after.

For a planting service, the 14 days run from the day we agree the service. If you ask us to start within that time and then cancel, you pay for the work already done.

If something is wrong

Our plants must be as described and of satisfactory quality, and our services carried out with reasonable care and skill. If a plant arrives damaged or is not what you ordered, tell us as soon as possible — a photo on WhatsApp helps — and we will put it right. These terms do not affect your legal rights as a consumer under the Consumer Rights Act 2015.

Looking after your plants

Living plants depend on watering, soil and weather after delivery. We give care advice with every order and are always happy to help. We are not responsible for losses caused by a lack of aftercare, extreme weather or damage after delivery that is outside our control, but this never limits the rights you have by law.

Trade customers

For business customers, the consumer cancellation rights above do not apply. Trade pricing, credit and payment terms are agreed in writing for each account.

Events outside our control

If severe weather, transport disruption or plant-health restrictions delay an order, we will tell you promptly and agree a new date or refund you for anything not supplied.

Law

These terms are governed by the law of Northern Ireland, and its courts can deal with any dispute. If you live elsewhere in the UK or in the Republic of Ireland, you keep the protection of the consumer law where you live.
